SC issued notice to ICSE in plea seeking adoption of CBSE’s re-assessment option for failed 9th and 11th students.

The Supreme Court, on August 18, 2020, issued notice to the Indian Certificate of Secondary Education (ICSE) in a plea seeking adoption of CBSE’s re-assessment option for failed 9th and 11th students. On May 13th, 2020 CBSE decided that all failed students of 9th and 11th will be provided with the opportunity to reappear in the school-based test. The plea states that if ICSE does not adopt the CBSE’s re-assessment option then it will be violative of right to equality, for students, guaranteed under Article 14 of the constitution. The petitioner, who is a minor and a student of class XI, also prayed that the petitioner may also be promoted to class XII in view of delay on the part of ICSE to adopt the CBSE’s notification of 13th may regarding re-assessment of 9th and 11th student and in view of COVID-19 raised infections.

The notice was issued by a bench of Justices AM Khanwilkar, Dinesh Maheshwari, and Sanjiv Khanna.
